Jason Beitchman represented the claimant, a lifelong athlete and accomplished coach, at an arbitration before the SDRCC in an appeal of Athletics Canada’s decision to remove the claimant as a member of Athletics Canada and from their hall of fame based on complaints of harassment. Mr. Beitchman successfully argued that the investigation into the complaints and resulting decision were procedurally unfair and biased by ignoring exculpatory evidence and unfairly conflating the investigation into the claimant with other ongoing investigations. The arbitrator agreed that the process was unfair and biased, and ordered to overturn the decision.
